Data Protection Bill has Concern Areas, Non-Personal Info, Localization Need
The parliamentary panel report said ‘the Data Protection Bill has many Concern areas like Non- personal info and localization need’.
The joint Parliamentary Committees (JPC) has discovered some issues in its operation in the Personal Data Protection Bill which is now changed to Data Protection Bill and found the issues which may arise while following the recommendations made by it.
Kazim Rizvi, the founder, Dialogue, a public policy think tank said that the main bone of contention is the wide range of powers given to the government that made them capable to handle and process data.
Rizvi also said a large number of dissent notes have been given by the members of the opposition. The efforts of members of Parliament have given little bit changes that can be seen in the change of section 35 of the act. But, the real scope and conditions are still unchanged and have the same wideness in their soul.
He added, “Though the JPC has in its recommendations added to this section, in its explanation, that the expression procedure used in the section entails a ‘Just’ fair, reasonable and Proportionate procedure’, the broad nature of terms and manner have not allayed surveliners concerns of this provision to exempt government agencies from the entirety of the bill”.
“Removing provisions on Non-personal data, avoiding mandatory data localization, and promoting cross border data transfer in the final bill will support Bill’s objectives which is the safeguard personal data and enhance privacy protection,” said Venkatesh Krishnamoorthy, India manager at the trade group.

The report by the JPC has been tabled in the House after 2 years before this 6 extensions have been made by the house. Experts have said that the report must go for the changes and it must be completed before presenting it in the Lok and Rajya Sabha.

The specific data localization clause and restrictions placed on cross-border data transfer also have global companies and trade groups worried. On the other hand side, the experts in this matter have their opinion that it could hinder the ability to enhance network resiliency and remediate in case of a data breach or outrage”.
Kumar Deep, the country manager of the information technology council said that all the changes related to the stakeholder should be discussed thoroughly before presenting the final bill.
He also added that some of the provisions including the inclusion of non-personal data, hardware testing, and compliance, should be discussed with the stakeholder to ensure they don’t severely restrict India’s ability to do business or stifle innovation and future investments.
